2. GENERAL TERMS AND CONDITIONS OF USE

The object of the conditions: The Website

The purpose of these General Conditions of Use (hereinafter, the “Conditions”) is to regulate access to and use of the Website. For the purposes of these Conditions, the Website shall be understood as: the external appearance of the screen interfaces, both statically and dynamically, that is, the navigation tree; and all the elements integrated both in the screen interfaces and in the navigation tree (hereinafter, the “Contents”) and all those online services or resources for information and comparison on financial products and services that it may offer to Users (hereinafter, the “Services”).

KreditFunds reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and the Contents and Services that may be incorporated therein. The User acknowledges and accepts that KreditFunds may at any time interrupt, deactivate and/or cancel any of these elements that are integrated into the Website or access to them.

The User

Access, navigation and use of the Website confers the status of User, and therefore, from the moment the navigation of the Website begins, all the Conditions established herein are accepted, as well as their subsequent modifications, without prejudice to the application of the corresponding legal regulations of obligatory compliance as the case may be. Given the relevance of the above, the User is recommended to read them each time he/she visits the Website.

The KreditFunds Website provides a wide variety of information, Content, Services and data. The User assumes responsibility for making correct use of the Website. This responsibility will extend to:

• Use of the information, Content and/or Services and data offered by KreditFunds that is not contrary to the provisions of these Conditions, the Law, morality or public order, or that in any other way may constitute an infringement of the rights of third parties or the operation of the Website.
• The veracity and legality of the information provided by the User in the forms provided by KreditFunds for access to certain Content or Services offered by the Website. In any case, the User will immediately notify KreditFunds of any event that allows the improper use of the information recorded in said forms, such as, but not limited to, theft, loss, or unauthorized access to identifiers and/or passwords, in order to proceed with their immediate cancellation.

Mere access to this Website does not imply the establishment of any type of commercial relationship between KreditFunds and the User.

The User declares that he/she is of legal age and has sufficient legal capacity to be bound by these Conditions. Therefore, this KreditFunds Website is not directed at minors. KreditFunds declines any responsibility for failure to comply with this requirement.

The Website is primarily aimed at Users residing in Spain. KreditFunds does not guarantee that the Website complies with the laws of other countries, either totally or partially. If the User resides or has his/her domicile in another place and decides to access and/or browse the Website, he/she will do so under his/her own responsibility, and must ensure that such access and browsing complies with the local legislation applicable to him/her, with KreditFunds assuming no responsibility that may arise from such access.

Service cost

Access to and use of the Website's services is completely free of charge for Users, except for the User's cost associated with the connection through the Internet service provider's telecommunications networks.

Registration

The use of any of the Website's Contents or Services may be done through prior subscription or registration of Users, who will be duly identified.

Through registration, a User ID is acquired, which will be the mobile phone number and password chosen, which will have been generated by the User during the registration process. This access code will be personal and non-transferable. These data will be requested each time the User wants to access his or her personal area in order to use the Website's services, and will therefore serve as an identification and authentication procedure in the system. The password chosen by the User will be personal and non-transferable, and its transfer, even temporarily, to third parties is not permitted. In this regard, Users undertake to make diligent use of and keep secret the password chosen to access the Website and/or the services it provides. In the event that Users become aware of or suspect the loss, theft or use of their password by third parties, they must notify KreditFunds of this circumstance as soon as possible.

Users are advised to change their password periodically. The User shall keep the password with due diligence and shall be responsible for any use or access to it by unauthorized third parties. KreditFunds shall not request by any means that the User informs them of the key or password that allows access to the Website Services. The User undertakes not to communicate the access key to third parties. Each User shall be liable for the costs and damages caused by the use of the services by any third party who uses their password for this purpose due to careless use or loss of the password by the User.

Comparison and information service on financial products and services

The User may access this service by completing the corresponding registration in the tab ‘How much money do you need?’, through the ‘Simulator’ or any other section which leads the User to complete the application form. To this end, the User will indicate the amount to be requested and the monthly repayment instalments of the loan. KreditFunds offers flexible personal loans that you can repay in 1 month or up to 6 years with a minimum APR of 7% and a maximum of 35%. For example, if you request a loan of €5,000 for 24 months, we will pay €4,825 into your bank account. (€5,000 less management fees). The total amount to be repaid will be €5,482.17 with an applied APR of 9.38%.

The User must complete the online registration application through the online questionnaire, so that KreditFunds can adjust the financial offers to your needs and profile. If any of the questions is not mandatory, this will be indicated on the form and the User may continue with the Service without having to answer that question. Once the User has answered the questions in the online questionnaire, KreditFunds will display, within a maximum period of 60 seconds, all the contract offers that are available in accordance with the information provided by the User in the questionnaire. All prices or rates that appear as available will include VAT, fees and any other applicable taxes and charges. Any other additional costs arising from the contract will be indicated clearly and precisely, provided that the financial product provider notifies us of this.

THE USER MUST BEAR IN MIND THAT THE OFFERS AND FINANCIAL CONDITIONS ARE PROVIDED DIRECTLY BY THE LENDING ENTITIES WITH WHICH THE USER MAY FINALLY CONTRACT, AND THEREFORE, KreditFunds HAS NO RESPONSIBILITY FOR SUCH CONDITIONS OR OFFERS, NOR DOES IT PARTICIPATE IN ANY WAY IN THEIR CONTRACTING, SINCE FOR THIS SERVICE, KreditFunds OPERATES AS AN INDEPENDENT AND IMPARTIAL COMPARATOR, WITHOUT ADVISING ON THE AVAILABLE PRODUCTS OR WHICH ARE BEST SUIT FOR THE USER'S PROFILE, SINCE THE OFFER WILL BE PROVIDED BY THE FINANCIAL ENTITY INDICATED.

Since the offers are provided by financial institutions, they may be modified at any time by them, so we recommend that the User check them with said entities before contracting the financial product or service. KreditFunds will not be responsible if the selected product is ultimately not available, nor for any damages that the User may suffer derived from the information provided by the financial entities in this service. Nor will it be responsible for any contingencies or damages that may arise in the relationship that the borrower maintains with the entities providing the service during the validity of the contract signed with them, or after its termination.
